Terms of Use

These Terms of Use ("Terms") are an agreement between you and Kimon Games ("we", "us") and govern your use of our games, websites and related services (the "Services"). By downloading, installing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of legal majority where you live, you may use the Services only with the permission of a parent or guardian, who also agrees to these Terms.

2. License

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and use our games on devices you own or control, for personal and non-commercial entertainment, in line with these Terms and the rules of the app store you downloaded them from.

3. Your account

You are responsible for keeping your login details safe and for all activity on your account. Give accurate information and tell us at [email protected] if you suspect unauthorized use. Accounts are personal: you may not sell, buy, rent or share them.

4. Rules of conduct

You agree not to:

• cheat, use exploits, bots, macros, modified clients or other unauthorized software;
• attack, overload, reverse engineer or interfere with our games or servers;
• harass, threaten, insult or discriminate against other players, or post hateful, sexual, violent or illegal content;
• impersonate others, including Kimon Games staff;
• sell, trade or transfer accounts, items or currency for real money outside the game;
• spam, advertise, or collect other players' personal information;
• use the Services in violation of any law.

We may moderate chat and remove content, and we may warn, mute, suspend or ban accounts that break these rules.

5. Virtual items and in-app purchases

• Our games may offer virtual currency and items ("Virtual Items"). You receive a limited license to use them in the game; they are not your property and have no value outside the game.
• Virtual Items cannot be exchanged for real money and cannot be transferred between accounts or games.
• Purchases are processed by Apple or Google under their terms. Refunds are handled by the store you bought from, except where the law requires otherwise.
• Where the law allows, you agree that delivery of digital content starts immediately after purchase and that you lose your right of withdrawal once delivery begins.
• We may change, rebalance or remove Virtual Items and their prices. If we permanently shut down a game, we will announce it in advance where reasonably possible.

6. Advertising

Some games show ads, including optional rewarded ads that give in-game rewards. We are not responsible for the content of third-party ads or the products they promote.

7. Third-party services

Our games use services provided by others, such as Apple and Google sign-in, the app stores and payment systems. Your use of those services is also governed by their own terms and privacy policies, and we are not responsible for them. Links to third-party websites are provided for convenience only.

8. Player content

You keep the rights you have in the content you create (such as chat messages and clan names). You grant us a worldwide, royalty-free, non-exclusive license to host, display, reproduce and moderate it as needed to operate and promote the Services. You confirm that your content does not infringe anyone's rights and follows these Terms.

9. Feedback

If you send us ideas, suggestions or bug reports, we may use them to improve our games without any obligation or payment to you.

10. Intellectual property

The games and all their content, including software, artwork, characters, music, text and trademarks, are owned by Kimon Games or its licensors and are protected by law. You may not copy, modify, distribute, sell or create derivative works from them except as these Terms allow.

11. Availability and changes

We update the games regularly and may add, change or remove features. Online features require an internet connection and may be unavailable at times for maintenance or for reasons outside our control.

12. Suspension and termination

You can stop using the Services and delete your account at any time (see Delete account). We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect players or the Services. Where reasonable, we will tell you why. Lost Virtual Items are not refunded when an account is closed for breaking these Terms, unless the law requires otherwise.

13. Disclaimer

The Services are provided "as is" and "as available". To the extent permitted by law, we do not promise that they will be uninterrupted, error-free or meet every expectation.

14. Limitation of liability

To the extent permitted by law, Kimon Games is not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability for intent, gross negligence, death or personal injury, or any liability that cannot be limited by law.

15. Consumer rights

If you are a consumer, you keep all rights that the mandatory laws of your country of residence give you. Nothing in these Terms takes those rights away.

16. Resolving disputes

If you have a problem with our games, please contact us first at [email protected]. Most issues can be solved quickly this way, and we will do our best to find a fair solution. Nothing in these Terms limits any right you have under the mandatory laws of your country, including your right to bring a claim where the law allows.

17. Additional terms for Apple devices

If you downloaded a game from the Apple App Store: (a) these Terms are between you and Kimon Games, not Apple, and Kimon Games, not Apple, is responsible for the game and its content; (b) Apple has no obligation to provide maintenance or support; (c) if the game fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price (if any), and Apple has no other warranty obligation to the extent permitted by law; (d) Apple is not responsible for any claims relating to the game, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims; (e) you confirm you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties; and (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Changes to these Terms

We may update these Terms. We will change the "Last updated" date and, for significant changes, notify you in the game or on this website before they take effect. If you keep using the Services after that, the updated Terms apply.

19. General

• Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
• No waiver: our failure to enforce a right is not a waiver of that right.
• Force majeure: we are not responsible for delays or failures caused by events outside our reasonable control, such as network outages, natural disasters or actions of authorities.
• Assignment: you may not transfer your rights under these Terms. We may transfer ours, for example if our games are sold, without reducing your rights.
• Language: these Terms are written in English. If we provide a translation and there is a conflict, the English version applies, unless mandatory law requires otherwise.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Services.
